These terms of use apply between you and Network Rail and set out the terms under which you may access the website (RouteView). These terms apply to all users of, and visitors to, RouteView, whether via the above URL or through the ORBIS GeoRINM viewer.

Your use of RouteView means that you accept and agree to abide by these terms. http://routeview.visivi.com/is operated by Network Rail Infrastructure Limited (Network Rail, we or us). We are registered in England and Wales under company number 02904587 and have our registered office at 1 Eversholt Street, London NW1. We are regulated by the Office of Rail and Road for our stewardship of the rail infrastructure.

Permitted Use
Aerial inspection and survey imagery (imagery) is made available on RouteView for use only by Network Rail employees and contractors, inspectors from the Office of Rail and Road (ORR) and Rail Accident and Investigation Branch (RAIB), and other users authorized by Network Rail who have been issued with log-in credentials. Imagery may only be used where necessary for the conduct of Network Rail, ORR and/or RAIB business, or in connection with railway safety or train performance activity.

Reliance on imagery
All imagery is provided without any guarantees, conditions or warranties as to its accuracy and is provided on an “as is” basis. To the extent permitted by law, we expressly exclude all conditions, warranties and other terms that might otherwise be implied by statute, common law or the law of equity.

We also expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with RouteView or in connection with the use, inability to use, or results of the use of imagery, including without limitation any liability for: (i) loss of income or revenue; (ii) loss of business; (iii) loss of profits or contracts; (iv) loss of anticipated savings; (v) loss of data; (vi) loss of goodwill; (vii) wasted management or office time; and (viii) for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation.

Data Protection
Network Rail takes steps to ensure that imagery does not contain personal data. However, imagery may occasionally contain personal data where, for example, individuals or car registrations are recognizable.

In relation to any personal data that you may view in the course of using RouteView you undertake:

to process such personal data only in accordance with these terms of use, and our instructions from time to time; not to disclose such personal data to any third party in any circumstances other than where necessary for the conduct of Network Rail, ORR and/or RAIB business, at the specific request of Network Rail, or if otherwise compelled by law to make such disclosure;

to indemnify Network Rail against all damages, losses, costs and expenses incurred or suffered by or made against us and whether wholly or in part resulting directly or indirectly from or connected in any way with any breach of this section headed “Data Protection”.

On termination of your rights of access to RouteView for whatever reason you shall cease to use such personal data and shall arrange for the prompt and safe return to Network Rail (or its nominated third party) or destruction, at Network Rail’s sole option, of all such personal data, together with all copies in your possession or control. We may require you to promptly confirm in writing to us that you have destroyed all copies of such personal data.

Where any such personal data is to be exported outside the European Economic Area as part of any processing by you or on your behalf, you shall obtain prior written consent from Network Rail. Any such consent given by us may be subject to additional requirements in relation to the processing of personal data.

Prohibited Uses
You may use imagery only for lawful purposes. You may not use imagery:

  • In any way that breaches any applicable local, national or international law or regulation.

  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

For personal use you also agree:

  • Not to reproduce, duplicate, copy or re-sell any part of RouteView in contravention of these term of use.

  • Not to access without authority, interfere with, damage or disrupt: any part of RouteView; any equipment or network on which RouteView is stored; any software used in the provision of RouteView; or any equipment or network or software owned or used by any third party.

  • Not share any images (or partial images) gained from Routeview for purposes of Social Media or other sharing platforms without prior permission of Network Rails Air Operations team.

Suspension and Termination of Use
We will determine, in our discretion, whether there has been a breach of these terms of use. Failure to comply with these terms of use may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use RouteView.

  • Issue of a warning to you.

  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

  • Further legal action against you.

  • Disclosure of information to law enforcement authorities as we reasonably feel is necessary.

  • We exclude liability for actions taken in response to breaches of these terms of use. The responses described in these terms of use are not limited, and we may take any other action we reasonably deem appropriate.
